What
the Law and MCI Says

Medical Council of India (M.C.I.), after incorporation of
sections 10A, 10B and 10C has become the ultimate authority in
matters of making regulations with respect to standards of
Medical Colleges and Educations including fixation of intakes
for various Medical Colleges in the Country. M.C.I. so amended
prevails over State University Act 1976 and Prohibition of
Capitation Fee Act, 1984.
2 .The Hon’able Supreme Court has held that “what is said
about the M.C.I. above applies to Dental Council of India (D.C.I.)
also under Dentist Act 1948.
3. M.C.I. regulations with regard to PG courses in Medicine
published in Part III, Sec. 4 of gazette of India dated 7th
October 2000 stipulate, that 50% of seats of intake should be
filled by Government and only the remaining 50% by the Private
Management. In both categories M.C.I. clearly states that
Merit should be the sole criterion for selection of candidates
4. Regulations framed by the medical council of India in
respect of PG courses are mandatory and binds all including
the university and the state governments.
5. The medical council of India had issued guidelines for the
yr 2000- 2001 in respect of all the medical and dental PG
admissions, which was, published in part III section 4 of
gazette of India dated 7th oct 2000 under which 50% of seats
are to be filled by management and 50% by Govt.
