Seats to PG medical and dental courses: HC reserves judgment on PIL

The Karnataka High Court today reserved its judgement on a public interest writ petition which had sought direction to the State government not to allot more than 50 per cent of the seats in post-graduate medical and dental courses to the managements of private colleges in the State. A division bench comprising Justice G C Bharuka and Justice A V Srinivasa Reddy reserved their orders after completion of the hearing on the petition which was filed in the second week of August this year. 
The division bench in its interim order passed in September had directed the State not to frame and/or enforce any Rule with regard to fixing of admission matrixes for the post-graduate medical and courses of higher education.
The High Court has also stayed the admission process to PG medical courses until the disposal of the case. The petitioner Mr R R Patil, former principal of S Nijalingappa College, Rajajinagar, Bangalore, has argued that despite the guidelines issued by the MCI, all the private managements in the State in collision with the State government have ventured to fill up 80 per cent of the sanctioned intake to various post-graduate courses in medicine and dentistry for the year 2000-2001, leaving only 20 per cent in the Government quota. 
The petitioner further argued that last year’s seat matrix shows that almost all the seats of the important branches in medicine and dentistry were given to private managements. In an outright violation of the norms, the State government has allotted more than 80 per cent of the total seats in the post-graduate courses in medical and dental disciplines under management quota against 50 per cent, alleged Karnataka State Junior Doctors’ Association (KSJDA). 
According to the Medical Council of India (MCI) regulations, 50 per cent of the seats in the post-graduate medical and dental courses should be allotted on merit basis by the government and the remaining 50 per cent by the management. There are 956 seats available from 14 private medical colleges in the state which would mean 478 seats for management quota and 478 seats for government quota. 
But, the government has violated the pattern by allotting 729 seats to the college management, Dr Vijaya Kumar H G, President, KSJDA said in a press conference here today. Also, of the 300 dental seats, 57 seats (19 per cent) fall under government quota, he added. 
The government’s move has deprived the poor meritorious students of their rights, he said and alleged that the government was hand in glove with the private management and has been lethargic in implementing the MCI regulations. The association has expressed its support to Dr R R Patil, who has filed a petition in the High Court and has also sought the support of dental and medical community. Comments : hi friends, I am student who joined a management seat this year. I whole heartedly support your cause. u people don't think that all students who joined are against u. I am a student who had put my complete effort for entrance exams for two and half years. I passed out of a govt medical college with 67%marks. many of my friends who fared badly in exams are doing there pg by reservation etc. i have chosen this way out of desperation. I wanted to tell just that there are many people who join here out of desperation. its very much true that merit should be the criteria and merit alone. management people are exploiting our helpless situation. I will pray for a just decision  for u people also. may good god help us. lets us all have a just decision  so that we can put our best effort to help the needy.

Comments : I was initially very pleased with Mr. R.R. Patil for starting this war on the students' behalf. but after 6 months of waiting for a seat of pg which I was sure of getting I am now really hating this whole struggle and the people who have denied me my seat and feel you all will be responsible if I cannot afford to wait any longer and have to forego my seat as well as my aspirations for pg as I had decided that it was just this exam or never. so u will be responsible for denying a meritorious 2nd ranker his right because of your prolonged struggle. if u were in my position then only would u understand otherwise it will be quite impossible for u to think in this way. thanks for nothing
PGA: Dear Dr. Hinduja,   Let's make one thing clear to you friend, Dr RR Patil is fighting this lone battle for the good of not just you or someone else or us, but it is for the benefit of the whole medical community as such. It's true that we all are playing a waiting game for the last 6 months or so and it has been a tough one for everyone. We do agree with that. But your anger should have been directed towards the indifferent attitude of the government, the money power of the management people or so. Instead we are surprised by you pointing fingers towards Dr RR Patil, who is really working hard and has got merit in his case.No one had the courage or fire in belly to fight this except for Dr RR Patil. Our's is a democratic nation and everyone has got a right to fight for justice and precisely this is what Dr RR Patil is doing. If you feel that he is doing wrong your are most welcome to fight against him in the court. A Little bit of patience on our side will definitely see us throu' this battle. One more thing we would like to tell you friend is that, it was Dr RR Patil who had started the battle and even without us he would have continued his fight and the result would have been the same. Since we the medical community people are the one who are going to benefit from this , we decided that we have to support Dr RR Patil and hence our group and so on. Comments : Hi, It's really a good news that SC has taken up our case even after its STATUS QUO but now will it say THERE NO SUBSTITUTE FOR MERIT OR THERE IN SUBSTITUTE FOR MONEY!!!! 'cause i think now management people are having upper hand since they have attorney general on their side hope at least GOD is with us. Then What is this RGUHS is saying that they have not approved candidates admission done under management quota for the year 2001-2002 if so is it a point to raised in front of Hon'ble SC Please let us know

Yes it's true that RGUHS has refused to approve the admissions made by the pvt colleges in view of the stay and the high court order. Comments : Dear PG Aspirants I am a bit surprised that the UG Medical Interns are not taking up to active protest . The Junior Doctors fight for trivial issues like increase of stipend . For a few thousand rupees they resort to strike from work . Today they have a legitimate right to get a PG Seat of their choice , a PG seat of their choice would decide in which direction their career for life would progress. Karnataka State Govt is blatantly violating the MCI norms . Additional efforts are required to step up the fight of PG Aspirants . Regards Tulasidass

Comments : hello,  could you please kindly update on the proceedings. There has been no information anywhere at all from the past 10 days or so. has the stay been vacated in supreme court? where is this fight "merit vs might" heading? it has already been a very long wait for this years students. ultimate decision might come in favor of the students. accepted.. but if it doesn't benefit this years students. then the entire effort and time has gone down the drain. statements like "...let it help our brothers and sisters or juniors.." sounds good!! but they really aren't helping much practically! 

it is very heart rending and very depressing for the students who are waiting for the decision and counseling ultimately. how long do they have to wait? no one has the answer. this is the first time( i think), that students score, have ranks and then wait....frustration and depression can already be seen in every pgaspirant. if this isn't going to help this years students after all that effort ...then maybe its wise to keep quiet and pave the way for counseling to take place rather than fight relentlessly for the 50-50 ratio... for next year. Because this years students have already lost very valuable time. anyway, I would request you again to kindly update this site frequently as this is the only site keeping track of this issue regularly and being the source of information for students all over Karnataka.

WISHING EVERYONE THE BEST OF LUCK FOR THIS YEAR. HOPE THEY DON'T HAVE TO WAIT LONG.
OKC: Your message has been conveyed to PGA Group and we will publish a response as soon as we get one.  For Now.. Our case will be filed on Monday the 11th of feb. It's being worked up .Counseling dates will be announced by the DME very shortly.   Dr RR Patil, advocates and we are trying our level best to get it done for this academic year. PGA Group: Dear Dr Ranjan,
Yes it's very true that we had not updated the site for the past 10 days, sorry for that, but for your information we are unable to get any information from either RGUHS OR DME.We are being kept in the dark so as you. 
As you know Dr RR Patil had won the case for us in the high court.Then he had just filed a caveat in the supreme court so that he will be informed if any related case comes to the court's notice. so it is the pvt managements who have pulled Dr RR Patil to the supreme court and not the vice-versa. Dr RR Patil never had the intention of prolonging the case.
Now the ball is in the DME's court. As a last measure we have filed a case(152 students) in the
court pleading it to vacate the stay. It was filed on 11-02-02. It may come before the court anytime from now. If it comes before the counseling dates and accepts our plea then it's well and good or else that's it -nothing more can be done for this year. This plea of our's to vacate the stay has nothing to do with the counseling dates. We are also not sure about why these people are not coming out with dates. They are probably taking legal advice from the law ministry to proceed with.Since certain informations are all oral statements we were not able to update it on the site. kindly excuse us for that.

We are also aware of the zero year issue and definitely don't want to disrupt the counseling
procedure even if it is 20-80 for this year. Hope you would understand our plight also.We are also as much worried by this time delay as much as you are.  Bye for now, and please keep in touch

Comments : Dear friends u r fighting for  future of medical students in Karnataka. One small suggestion from my side it is not that you don't know about this but still for my happiness I wanted to tell you that why don't you (including me) come out with the interns fight it out by boycotting the work. This is just becoz our fight is not getting enough public attention and media encouragement. So why don't we all of us get out on to the roads so that it will attract enough public attention and media coverage so that then govt may compelled to come out do something. Let us remember that even earlier demands of the medical students used to be solved by the interns association. Otherwise how long this fight can carried after all this is question of the whole state. One more thing is to write letters to union ministers like Mr.Arun Jaitley and Arun shourie who are known to be people friendly. This is not to irritate you people who have already taken enough pains so far. If u find my suggestion useful please do try it out. Thanking u and hoping for the best and all the very best of luck.

Comments : hi,    I am a student with a good rank waiting for the things to settle down...I needed a clarification about the loss of term. there are strong rumors doing rounds that if we don't get admission within 31st march 2002 we will lose our ranks ,and the year declared a zero year and the entrance will be held once more..   well is it true? or else what is the real thing about this zero term?    please help us all here to clear this doubt.

OKC: Dear Anand,     It's true that march 31'st is the dead line regarding the zero year issue. When we spoke to DME people, they have told us that march 31'st is the deadline for the admission procedure to be completed and they are planning to conduct three rounds of counseling well within this date. When we enquired about the entrance rankings issue they declined to comment on that and just told us that we shouldn't worry much on that and in all probabilities they will conduct counseling before 31'st march.
