The Karnataka High Court today reserved its judgement on a
public interest writ petition which had sought direction to
the State government not to allot more than 50 per cent of the
seats in post-graduate medical and dental courses to the
managements of private colleges in the State. A division bench
comprising Justice G C Bharuka and Justice A V Srinivasa Reddy
reserved their orders after completion of the hearing on the
petition which was filed in the second week of August this
year.
The division bench in its interim order passed in September
had directed the State not to frame and/or enforce any Rule
with regard to fixing of admission matrixes for the
post-graduate medical and courses of higher education.
The High Court has also stayed the admission process to PG
medical courses until the disposal of the case. The petitioner
Mr R R Patil, former principal of S Nijalingappa College,
Rajajinagar, Bangalore, has argued that despite the guidelines
issued by the MCI, all the private managements in the State in
collision with the State government have ventured to fill up
80 per cent of the sanctioned intake to various post-graduate
courses in medicine and dentistry for the year 2000-2001,
leaving only 20 per cent in the Government quota.
The petitioner further argued that last year’s seat matrix
shows that almost all the seats of the important branches in
medicine and dentistry were given to private managements. He
has also sought a direction to the State government not to
deviate from the MCI guidelines while fixing seat matrix for

In an outright
violation of the norms, the State government has allotted more
than 80 per cent of the total seats in the post-graduate
courses in medical and dental disciplines under management
quota against 50 per cent, alleged Karnataka State Junior
Doctors’ Association (KSJDA).
According to the Medical Council of India (MCI) regulations,
50 per cent of the seats in the post-graduate medical and
dental courses should be allotted on merit basis by the
government and the remaining 50 per cent by the management.
There are 956 seats available from 14 private medical colleges
in the state which would mean 478 seats for management quota
and 478 seats for government quota.
But, the government has violated the pattern by allotting 729
seats to the college management, Dr Vijaya Kumar H G,
President, KSJDA said in a press conference here today. Also,
of the 300 dental seats, 57 seats (19 per cent) fall under
government quota, he added.
The government’s move has deprived the poor meritorious students of their rights, he said and alleged that the
government was hand in glove with the private management and
has been lethargic in implementing the MCI regulations. The
association has expressed its support to Dr R R Patil, who has
filed a petition in the High Court and has also sought the
support of dental and medical community. More details could be

Comments : Dear Friends,
The supreme Court (SC) stay has come in as a major blow to all our aspirations
and prolonged wait.A few of the News Dailies have already interpreted the stay
as a valid right being granted to the DME to conduct this year's
counseling on an 80:20 basis. If this were to be true, then all the wait and immense efforts from
Shri.R.R. Patil's side, OKC team and many others would go down the drain.
Being a part of the Aggrieved or aggrieved-to-be as the case may be,
I would like to draw your attention to a few points which struck to me out of
this whole mess...
1.That the DME had to conduct the counseling on or before 15th Jan 2002
according to the High Court order.
2.That the Managements were wary of the presiding justice of educational cases
in the SC who was to vacate the bench on 20th Jan 2002.
3.That Dr.Parameshwara, Minister for Higher Education, very well known to be a
Hand-in-glove man with the managements suddenly started claiming that the High
Court order would be implemented (what a change overnight!!) and that too till
lately...
4.Putting (1) plus (2) plus (3) we would get to know that the managements were
desperate to bide time on their part and were ultimately successful largely due
to the able ally they found in the form of REGISTRAR & CO., RGUHS!!!
Let me explain..... Had the rank list and Seat matrix been legitimate and valid, and not involving
any controversies, the counseling would have been long over by now and even before the managements
could have a say in it...... That, a CET involving multiple varsities
with differing examination, evaluation and marking patterns can NEVER have marks being drawn from the qualifying degree
examination apart from the minimum marks prescribed for the sake of
eligibility........is too well known even to a small kid.......WONDER IF the
REGISTRAR & CO., RGUHS were not aware of even such trivialities!!
Dividing the students was one of the most effective ways of stalling things and
that they have done successfully.... with cases being filed serially in the high court and the HC squashing all the
orders, matrix and rank list without a second thought and a second hearing
indicates the foolishness with which the RGUHS has behaved....or that's what we
think...
On the contrary, they have been extremely intelligent in prolonging things and
providing the needed leverage to the MONEY MIGHTY MANAGEMENTS...[Who have roped
in people like Soli Sorabji, Attorney General, to fight for their
(un) just cause...] what a shame that a man of the standard of Attorney General fights for
money.....
I am now confident that the DME will in all earnestness conduct the
counseling at the earliest date possible on an 80:20 basis and thereby providing leeway to
the managements to get away with this year's measly earnings of over 100
Crores ONLY!!!! Not prolonging my letter any further, I would now request OKC team to open a
forum for suggestions and opinions on the developments that have taken place
since 26th Jan.....and design out a Plan Of Action to STALL ANY MOVE TO CONDUCT
THE COUNSELING BEFORE THE CASE IS DECIDED IN THE SC.
If action has already been taken in that regard, I request the OKC team to put it up on the message board so that it would
relieve tensions from hundreds of PG seat Aspirants. I would like to sign off thanking the masters of this web site, yet again, for

states the Supreme court has issued a stay order with regards
to the decision given by high court. Can Dr.R.R Patil please
explain what sort of justice have the students got after so
many months. Neither did they get the justice, they even lost
6 months.

Comments : I think it is a welcome move to give 50%
weightage to under-grad marks. This will ensure that only
students who are meritorious throughout get to do PG. A
profession like medicine, should be practiced only by people
who learn it sincerely. Once you are a doctor, people treat
you like a God. There should be no question of reservation
coming into picture. It is possible that a person how has just
managed to clear his/her under-grad, but did a guess work in
the entrance exam and luckily all answers come correct. Does
he/she deserve a PG seat?

Comments : Here is a request from me who had rank no.690 in
second list and 1149 as per the revised list considering 50%
of UG marks [Roll no.MV0338] I had score of 99.5 in entrance.
Just because 0.5 marks less in the entrance, my rank has gone
back approximately 450 ranks in the revised list. Is there any
solution for this? Why can not the concerned authorities
implement such a rule so as to consider 50th 'percentile'
rather than percentage as an eligibility criteria? Making one
kind of rule for the first 671 candidates and another rule for
rest, is how far justifiable? Can anybody suggest regarding
this problem?

Dear Friends!
I am an intern at jnmc, belgaum, and a candidate from the first
RGUHS batch, and shall be appearing for my first Karnataka pg entrance this
year, and hope that all the crises come to an end before we take that,&
a word about choosing merit based on pure entrance based performance is
correct, as even in the RGUHS batches, in different colleges there is disparity in the internal
assessment, and there is lot of change in the marks distribution of our junior
batches, with more weight-age of marks over internal assessment
viva & practs, so every student who aspires of getting a seat in pg entrance shall indulge in malpractice which is
already present, So I appeal to all my junior Doctor friends,
that only entrance based merit to be chosen,& already our seniors have the won the case for

We should all fight against the new kind of merit, aggregate of theory and
entrance, just to fill up the seats they can't make us scapegoats,
i say this
bcos, we know that different colleges get rank percentage even in the
rguhs, with lot of things going on in the internal assessment and vivavoce and
practs,
also we have only one distinction for whole university and our
counterparts studying in Manipal college also eligible for state entrance have 18
distinctions, which clearly gives us an idea that the present way of
selection will affect the students performance even before he or she gives his entrance exams,&when the
whole country picks the merit based on entrance why should our state find this
new system, for that matter even the foreign countries exams like usmle are based
purely on the entrance, so I want tell all of you only one thing that we should
fight against this new rule, when our fight was ``merit prevails over money&there
is no substitue for merit, where did this new scheme of merit list come
here ??????????.Thanks.

Comments : today i heard that the rank list is going to
be revised as MBBS marks(50%) and CET marks (50%). if the
ranking is drawn according to the above formula then an
average student who has scored less in MBBS theory will have
no chance of getting a seat. this is chaos. students are not
given a chance to fight in CET rat race and win a seat. rank
students have not proven their mettle in cet exam but they
have done in MBBS ug exams. some body should oppose this dirty
rule. merit list should be based entirely on cet rank list.

the malpractices like question paper leaks. if you guys really
want to clear the garbage, it should be total. you have been
keeping quiet for so many years & have come up with this
issue now. remember any problem has to be solved in the
initial stage not when it has reached a stage when any slight
move will lead to catastrophic results. what about the unrecognized
colleges which function even today, the students who appear
from these colleges for the entrance exams? further what is
the guarantee that a merit student will follow all the ethics
in his daily practice, in the present world where money rules
the roost. agreed that the private colleges charge a heavy amount, but
has any committee been set up to see the facilities these
colleges provide or for that matter, what is the operating
costs? sure specialization is an earned degree not what the
colleges give. if this 100% merit rule is executed what is the
guarantee that so! me crackpot politician comes up with an
idea of raking up the reservation policy, asking more reservations. you
have also stated the MCI laws. what was the MCI doing all
these years? was it not aware, or turned a blind eye for
reasons unknown!!!!.i think there is a lot of political
lobbying going on even in this case. someone is settling his
personal grudge with a public litigation. at the end its clear
this country is definitely going towards doomsday.

Since I am from a city where dental college is there,& in dental field there is
complete saturation in certain dept.,eg., ORAL SURGERY & there is no job for the people who had completed there
M.D.S. I am talking about the KANNADIGAS & according to the
judgment all the 100% seats goes to KANNADIGAS, as i wont to inform you the dental treatments are not emergency one
usually for the social service there is no need of specialization
as normal B.D.S. degree is enough. Most of the pg aspirant in dentistry
goes for the pg only to get job in any of the colleges .
If there is 100% seats for KANNADIGAS there will be an excess of pg output those pg output can not accommodate any of the colleges. This
judgment in terms of long term will only waste 3 more precious
years of the student, as they were left with no job. It was
better you would have allowed
minimum no seats to non Karnataka students. Though i was pg aspirant now i am thinking to quit the profession as there is
no future for me. Whether it is an Merit or through management

court or the college management. What will happens if colleges are not ready to agree the

Regional linguistic minority colleges are 50% for management whether this will be filled by the rguhs or the college management itself. Is there any chance of

you're doing but What I feel is that private management
people are just want to drag the court's hearing 'cause if
hearing comes against them then they can say that we'd
already admitted students under management quota for this year
and also it's more than 6 months since the term has started so
to apply the rule from next year but hey friends RGUHS has
already mentioned in their entrance prospectus that 2001
classes will commence from 2002 JAN so friends do not go for
compromise 'cause the decision will be permanent
for the future also, it's also known that a MIGHT student will
for sure getting PG seat next year but for MERIT student it's
not so. So We'll fight for 50:50 rule and will win Wish

Sub: to bring to your notice the govt.'s attitude favoring "the
in-service and ESI candidates" over the entrance candidates.
my name is zameer and I have been in the entrance preparations
from last two years and i have observed that last year govt.
had allotted 19% of seats from private colleges to the merit students.
And out of these 19% the govt. had allotted 40% of seats to the
in-service and ESI. candidates, when actually they deserve some 5 to 10 % only.
This means that we will be at a ' LOSS OF SOME "100"MASTER DEGREES IN
CLINICAL SUBJECTS'
So this is my request to you to please bring this matter to the notice of the
petitioner and his advocate and request them to put this matter before the
honorable court, and let hundreds of candidates get their rights.
Finally praying and hoping to be victorious in this fight rightly called,
"MIGHT v/s MERIT".

notice that the supreme court has issued a judgment which is
reported in 'the hindu' dated 16th of October, page 13.it is
clearly stated that the state govt. or universities cannot
dilute MCI standards. And the court has also mentioned that
50% of the seats have to be allotted by the govt. on merit
basis. please take note of it .it will
help us a lot in our fight for justice. best of luck

Dear KSJDA members,
All of you must have seen what was in yesterdays Deccan herald
about the ministers answers to the allotment of the 80% seats
to management. This has been going on, with Karnataka being
one of the violators in so many areas supported by the private
medical college managements and ultimately by our own senior
medical professionals and the MCI members. This is a nexus
between the politician unscrupulous doctors the private
college managements and MCI.
All are involved .I would advice you to go back to what all
happened in the past. The people whom you are up against are
powerful however I wish you all the luck.
